Welcome to Flytrail.

We're a self-drive road trip company that takes small groups off the beaten path — through wild landscapes, remote roads, and places most travellers never see. This document sets out the terms that apply when you book a trip with us. We've written it in plain language so you actually understand what you're agreeing to. Please read it carefully before confirming your booking — by paying a deposit, you're confirming you've read and accepted everything here.
A note before you read on: This is a legal agreement. If anything is unclear, please contact us before booking. We'd rather you ask questions upfront than be surprised later.
1. About Your Booking
When you book a Flytrail trip, you enter into an agreement directly with us. Your booking is confirmed once we've received your deposit and sent you a written confirmation.
Who can book
  • You must be 18 or older to make a booking.
  • The lead booker is responsible for sharing these terms with everyone in their group.
  • Everyone travelling with you is bound by these terms.
Driving requirements
  • All drivers must hold a valid driving licence that is recognised in the destination country.
  • Some countries require an International Driving Permit (IDP). We'll let you know at the time of booking if one is needed.
  • You should be a confident, experienced driver — but off-road driving experience is not required.
  • You must not drive if your ability is impaired in any way — by alcohol, medication, fatigue, or any other reason.
Driving assessment on Day 1
On the first day of every trip, our expedition leader or trip expert will conduct a brief driving assessment of all participants who will be driving. This is a standard part of every Flytrail trip — not an exception.
The purpose of this assessment is to ensure the safety of everyone in the group. Our trip leader's decision following the assessment is final.
What this means for you: If our trip leader determines that your driving presents a safety risk — whether due to skill level, unfamiliarity with the vehicle type, road conditions, or the comfort level of fellow passengers — we reserve the right to remove you from driving duties for part or all of the trip. This decision will not be taken lightly, but when made, it is non-negotiable.
Specifically:
  • Fellow passengers have the right to raise concerns about another driver's driving to the trip leader at any point during the trip.
  • The trip leader may reassess any driver at any time during the trip if safety concerns arise.
  • A driver may be removed from driving duties at any point — on Day 1 or any subsequent day — based on the trip leader's assessment.
  • Where possible, we will offer practical alternatives such as redistributing passengers across vehicles, adjusting driving rotations, or other reasonable accommodations.
No liability for driving decisions: Flytrail's decision to restrict or remove a participant from driving — whether on Day 1 or at any point during the trip — does not entitle you to a refund, compensation, or any claim against Flytrail. By booking with us, you explicitly agree that Flytrail, its trip leaders, staff, and partners cannot be held liable for any loss, inconvenience, or expense arising from a driving assessment decision made in the interest of group safety. This includes any costs you may incur as a result of alternative transport arrangements.
2. Payments
Deposit: A deposit is required to secure your place on a trip. The deposit amount will be confirmed at the time of booking.
Final payment: The balance must be paid by the deadline we give you at booking. We accept bank transfer (RTGS/NEFT), cheque, digital transfer, and major credit cards.
Important: If either the deposit or final payment is not received on time, your booking may be automatically cancelled. We'll do our best to remind you, but the responsibility to pay on time rests with you.
3. Cancellations & Changes
If you cancel: Cancellation fees depend on how far in advance you cancel. Our full refund policy is published separately at www.flytrail.com/refund-policy. Please read it carefully before booking.
Illness, accidents & family medical emergencies: If you are unable to join the trip due to personal illness, injury, or accident occurring before departure — or due to a medical emergency involving an immediate family member — this will be treated as a standard cancellation under our regular cancellation policy. The applicable cancellation fees will apply based on how far in advance the trip is cancelled, as outlined in our refund policy at www.flytrail.com/refund-policy.
Flytrail is not in a position to make exceptions to this policy, regardless of the circumstances. We understand these situations can be distressing, and we genuinely sympathise — however, the financial protection for such events is precisely what travel insurance is designed for. Any compensation or reimbursement you seek for prepaid trip costs must be claimed through your travel insurance provider. This is one of the key reasons we require comprehensive travel insurance as a mandatory condition of booking (see Section 5).
If we cancel : We rarely cancel trips, but if we do — and we cannot offer a suitable alternative — we will refund you for the trip. The refund will be issued in one of the following forms, depending on the circumstances:
  • A credit note, valid for use against any future Flytrail trip.
  • A bank transfer refund to your original payment account.
  • A combination of both — part credit note and part bank transfer — where circumstances make a mixed approach appropriate.
How we decide the form of refund: The form of refund will be determined by Flytrail based on the reason for cancellation, timing, and any costs already committed on your behalf. Our goal is to find the most practical and fair resolution for both parties.
Please note: Flytrail's refund, in whatever form it is issued — is strictly limited to the amount paid directly to us for the trip. We are not responsible for, and will not reimburse, any flight tickets, visa fees, travel insurance premiums, or any other expenses you may have incurred in connection with the trip.
In all cases, Flytrail's total liability will not exceed the net amount you paid us for the trip.
Changes to your trip
We plan our trips carefully, but things don't always go to plan in remote destinations. We reserve the right to alter itineraries, routes, or timings without prior notice when required by safety concerns, weather, mechanical issues, road conditions, local regulations, or circumstances beyond our control. We will always act in your best interests when making changes.
4. Your Travel Documents
You are responsible for making sure all your travel documents are valid and ready before you travel.
What you need to arrange
  • A valid passport (check expiry dates — many countries require 6 months' validity beyond your travel dates).
  • A visa, if required for your destination. We'll advise you on this during the booking process.
  • An International Driving Permit, if required.
  • Travel insurance — see Section 5.
Flight disruptions & airline issues: Flytrail does not book, manage, or have any control over your flights. Any disruption arising from your airline or related travel arrangements — including but not limited to flight cancellations, delays, missed connections, delayed or lost baggage, denied boarding, or late arrivals at the trip's starting point — is entirely outside our remit. Flytrail accepts no liability for any such disruptions, and they do not entitle you to a refund, compensation, or any adjustment to your trip cost. We strongly recommend purchasing travel insurance that includes adequate cover for flight-related disruptions.
Please share copies of your flight details, visa, and IDP (where applicable) with us before the trip starts.
5. Travel Insurance
This is not optional: Every Flytrail traveller is required to hold comprehensive travel insurance before departure. This is a firm condition of your booking.
Your policy must include - at a minimum:
  • Emergency medical treatment
  • Medical evacuation (medevac)
  • Trip cancellation and interruption
  • Baggage loss or damage
Medical evacuations from remote locations can cost tens of thousands of dollars. If you travel without valid medevac coverage and an evacuation is required, you will be personally liable for the full cost. We cannot and will not cover this on your behalf.
Please provide us with your policy number and the emergency contact number for your insurer before the trip begins.
6. Vehicles
We use well-maintained vehicles from trusted local rental partners. Some of our partners have their own rental agreement, which you may be asked to sign at the start of the trip.
Before you drive : Check the vehicle carefully before setting off on Day 1. If you notice any existing damage, report it to our representative immediately. We will document it together so there are no disputes later. You'll return the vehicle in the same condition you received it.
While you're on the road
  • Only the drivers listed in the rental agreement may drive the vehicle.
  • Use only the fuel type we specify — using the wrong fuel can cause serious damage.
Wrong fuel — your liability: Filling the vehicle with the incorrect fuel type is one of the most avoidable and costly mistakes on a road trip. Our team will clearly inform you of the correct fuel type before you drive. If the vehicle is damaged as a result of misfuelling, the full cost of repair, recovery, and any associated losses will be your responsibility. This is not covered by the standard vehicle insurance.
  • Carry out basic checks regularly: oil level, tyre pressure, water.
  • Always lock the vehicle when you leave it, even briefly. Never leave keys in the ignition.
  • Stick to designated roads and the planned route unless we specifically approve otherwise.
  • Follow all local road traffic laws without exception.
Prohibited uses
The vehicle must not be used for any of the following - violation may result in your immediate removal from the trip without refund, and you will be personally liable for any resulting costs or damages:
  • Driving under the influence of alcohol, drugs, or any substances that affect your ability to drive. We have a strict zero-tolerance policy on drink/drug driving.
  • Carrying flammable, hazardous, or illegal materials.
  • Renting the vehicle to or allowing it to be driven by someone not listed in the agreement.
  • Transporting passengers for payment.
  • Towing or pushing other vehicles.
  • Off-route driving on unmarked or unauthorised roads.
  • Any use that breaks local laws.
Mechanical problems
If a warning light comes on or you notice anything unusual, stop safely and contact us immediately. Do not arrange your own repairs without our approval — unauthorised repair costs will not be reimbursed.
Accidents, theft, or confiscation
If the vehicle is involved in an accident, stolen, or impounded by authorities, you must contact us immediately. You are responsible for all costs and damages arising from incidents that occur under your watch, unless Flytrail is directly at fault. Flytrail accepts no liability for personal belongings, baggage, or items left in the vehicle.
End of trip
Return the vehicle and all keys to our representatives at the agreed location and time. If you return the vehicle without keys, you'll be charged for replacement.
Vehicle insurance
All vehicles carry third-party liability cover for bodily injury and property damage. This is included in your trip cost. You remain responsible for damages that fall outside this cover, including any excess, or damage caused by prohibited use.
7. Health & Medical Fitness
Flytrail trips are active, sometimes remote, and occasionally at high altitude. You should be in good general health before joining us.
What you need to tell us
  • Any medical condition physical or mental that might affect your participation, including allergies.
  • Susceptibility to altitude sickness (relevant for destinations like Kyrgyzstan, etc.).
  • Any medication you take that may affect your ability to drive.
Please disclose this information at the time of booking, or at the latest within two weeks of confirming. If a condition becomes relevant after booking, tell us as soon as possible.
Why this matters: If you misrepresent your health status and it becomes apparent during the trip, we reserve the right to remove you from the trip without refund. We don't want that to happen, so please be upfront with us.
Medical assistance on trip
Our team will do their best to help if you fall ill or are injured. If required, we may take you to the nearest medical facility. The attending doctor's decisions regarding treatment or evacuation are final. If you refuse a doctor's recommendation, Flytrail accepts no liability for any resulting consequences or expenses.
Any medical costs, evacuation costs, or additional expenses arising from your illness or injury are your responsibility — which is why travel insurance with medical cover is mandatory.
Travellers with disabilities
We're happy to accommodate travellers with disabilities where it's feasible for us to do so. Please contact us before booking so we can discuss your needs and confirm whether appropriate accommodation can be arranged.
8. Your Behaviour on Trip
We travel in small groups, often in close quarters in remote places. Mutual respect — for your fellow travellers, our team, local communities, and the environment — is not optional. It's a condition of travel.
Your responsibilities
  • Follow all local laws and regulations.
  • Listen to and follow safety instructions from our team at all times.
  • Be respectful to other travellers, our guides, and local communities.
  • Behave appropriately for the destinations and communities you're visiting.
Grounds for removal
We reserve the right to remove anyone from a trip without refund who:
  • Behaves in a hostile, threatening, or abusive manner toward our team or other travellers.
  • Disregards the safety or wellbeing of others.
  • Repeatedly ignores our instructions.
  • Puts the group or the trip at risk through reckless behaviour.
Prohibited items
You must not carry weapons, explosives, or flammable materials at any time during the trip.
Illegal substances
The possession or use of illegal substances is strictly forbidden and grounds for immediate removal from the trip without refund. You will also face arrest and prosecution under local law. Penalties vary by country and can be severe — in some destinations, possession of even small amounts can result in trafficking charges and lengthy imprisonment before trial.
9. Photography & Media
Photos we take: We sometimes photograph or film trips for use in our marketing and social media. By booking with us, you agree to your image being used for these purposes. If you'd prefer not to be included, please tell us in writing before the trip begins and we'll respect that.
Photos you take: Any photos or videos you take remain yours. However, if you share them with us, you grant us a non-exclusive licence to use them for editorial or promotional purposes without any obligation of credit or compensation.
10. Dietary Requirements
If you have special dietary needs, please tell us when you book. We'll do our best to accommodate you, but in remote destinations the availability of certain foods can be limited. We cannot guarantee all dietary preferences can be met in every location.
11. Liability & Risk
The nature of what we do : Flytrail operates in remote, often challenging destinations. Our trips involve driving on varying road conditions, exposure to extreme weather, high altitudes, and travel in areas with limited infrastructure. By booking, you acknowledge and accept these inherent risks.
What you accept: You acknowledge that adventure travel carries risks — including the possibility of accident, injury, illness, or death — and that you are participating voluntarily and in full awareness of those risks. You agree that Flytrail, its owners, staff, agents, and partners are not liable for any loss, injury, or death arising from your participation in the trip, except where caused directly by our proven negligence or wilful misconduct.
Our liability cap: In all circumstances, Flytrail's maximum liability to you will not exceed the amount you paid us for the trip.
Third-party suppliers: Many of the services we arrange — accommodation, local transport, equipment, activities — are provided by independent suppliers. While we select them carefully, we do not control their operations. Flytrail is not liable for any loss, delay, injury, or inconvenience caused by third-party suppliers. Each supplier is subject to their own terms and applicable local law.
Force majeure : We are not liable for failure to deliver any part of the trip due to circumstances beyond our control — including but not limited to: natural disasters, extreme weather, strikes, civil unrest, terrorism, government actions, or pandemics. In these situations, we are under no obligation to provide refunds or alternative services, though we will always try to help where we reasonably can.
12. Disputes & Governing Law
We genuinely hope you never need to use this section. But if a dispute does arise:
  • We'll first try to resolve it directly and informally — please contact us and give us the chance to put things right.
  • If we can't resolve it directly, the dispute will go to a neutral third-party mediator based in Siliguri, India. Both parties will share the cost equally.
  • If mediation fails, the dispute will be referred to binding arbitration under Indian law, with arbitration seated in Siliguri, India.
  • The maximum amount you can recover in any dispute is the net amount you paid Flytrail for the trip.
These terms are governed by the laws of India.
